Legal Question in Construction Law in Florida

Statute 558.001-558.005

Can you please explain this statute to me, the judge put my case in abate until the statute is met. I think I did comply with it already, my letting the owner come in my home and see the work done at the time he said all was normal. But if I wanted a independent inspector we could do that. I chose to call the fire marshall regarding code and the maunfacturer to come out and make reports which I have. But do I have to let them come back again 3 months later and have an expert come out. I had to rebuild our staircase during the time since it was unsafe and against code as stated by the fire marshall.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorneys individualized advice for you. By reading the Response to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

RESPONSE: Chapter 558 has to do with complaints regarding construction defects. It has become a trap for the unwary owner. IF you need assistance I recommend contacting a lawyer. I don't know anything about your case, but "generally" when dealing with that statute I usually hire an expert to review the defects and then place the contractor on notice reasonably detailing the defects. But really, you need to contact a lawyer. Good Luck,

Randall Gilbert
