Consent Final Judgment

I have a revolving credit line debt. I stopped making payments because the debt settlement company I was with told me to do so. A lawyers office called and told me I was being sued and threatened to garnish my wages. So I agreed to a payment plan. The debt settlement company was unable to get me a lower settlement, etc. I am wondering what is a consent final judgment? If I sign and return this will I have to go to court? If not, will they sue me?

You should have been served with the lawsuit.

You can be served by substitute service, meaning the process server can give the papers to anyone who lives in your house who is 15 or older. And, no, they don't have to sign for it. If the process server gives you the lawsuit, that's called personal service. And, no, you don't have to sign for it either.

A consent final judgment is exactly what is sounds like - you are consenting to the entry by the Court of a Final Judgment. The whole point of the consent final judgment is to avoid going to court. It will also tend to keep the attorneys fees down.
