Credit cards and liens

I have a debt for $1100.00 to Capitol one that I have defaulted on. I was served a subpena to go to small claims court. I owe the money but cannot pay it. I earn approx $7000 a year (140.00 a week). I have no bank account.. I own a mobile home worth about $1000.00 and a car worth about $4000.00. I have no other assets. I already have a lien put on my Tax refunds for a student loan. I am 56 years old. Can they take my home or car? Can a lien be placed on my car or mobile home and what would that mean. Can a lien be placed on property if it is jointly owned with another person not named in the complaint? Thank you

Your homestead is safe from creditors claims including Capitol One. Your car might not be if you have equity but no debt on it although it is unlikely that the credit card company will attempt to levy on your vehicle.

I would suggest that you consider a repayment plan with Capitol One. When you go to court, explain your situation to the judge or mediator and ask to make payments. Often, a judge will take your financial situation into consideration and push the Plaintiff into taking smaller payments than they might otherwise like to accept.

Most card companies will settle the debt for a payment arrangement or lesser amount. It may be in your best interest to resolve the issue that way since the amount is well below the assets you listed.
