Old debt and collection

My father just received a letter from a collection agency concerning a debt from 15 years ago. He has been out of the US for most of that time and now lives in Fl and collects social security. What is the law regarding old debts such as this and what should he do?

This may trigger he FDCPA. We would need more details to see if there is a violation. It will cost you nothing if you wish for us to pursue the matter. If there has been a violation your father may be entitlted to an award of $1,000. (This is a fine levied against the creditor for unfair collection practices.) You may write the creditor a letter saying you have no assets and that there is nothing to garnish. It is unlikely that they can sue on the debt as I believe it is past the statute of limitations (unless it is for a municipal debt) Feel free to contact us.
