Legal Question in Credit and Debt Law in Florida

Lawsuit filed regarding repossession of vehicle

My sister and father both received a summons to notify them that a lawsuit had been filed against them concerning a Honda Civic that has been repossessed in New Jersey. The Legal Aid office here in Bevard County will not assist us. If we draft a letter and have it notarized and sent to the attorney they specified and explain that the debt is to be repaid and would like work out a payment plan is that sufficient? We have 20 days for a written response to the Court. It just says Brevard County Court with a Case # on it, so I guess we have to call for the address and than mail a copy to the Plaintiff's attorney. Any advice?

Such a letter will not prevent a judgment from being entered against them. I suggest they retain an attorney to file an answer and try to work out some arrangement. Time is of the essence.

Good luck.
