Student Loan placed in DEFAULT without knowledge

My student loans have been placed into default with out giving me any notification. I never received the statements because they had an incorrect address. Because there was no response from me they placed the loans into default and placed this on my credit report. Having this negative report have caused me to be declined for a credit. After this was brought to my attention, I contacted the higher education department and agreed to make payments bi-monthly to get it out of default. I requested that it be removed from my credit report as being in default. But they stated no, to bad. Do I have any legal recourse; To get this removed.

Probably not. You can place in your credit report file a brief explanation of the cause of the comment.
