Legal Question in Criminal Law in Florida

burglary w/ assault and battery

someone i know was sentenced to house arrest for 2 years for burglary with assault and battery. that is not what they did, but their lawyer sucked and told them to plead guilty, so now in the laws eyes, that is what he did. he got off of house arrest after serving a year and a half of that time, and was just on probation. 4 days later he went out with his friends and got into a fight while walking down the st. the people said they busted down the door. so, he got charged again with burglary with assault and battery (2 counts) and v.o.p. warrentless. what is the outcome of this?

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you do not agree, then stop right here, and do not read any further.

Only the judge will be able to decide the outcome. Your friend needs to get a better attorney who can represent him and try to get the charges dropped if they were not correctly filed. Of course, if your friend did as charged, he will have to live with the consequences of his actions.

Re: burglary w/ assault and battery

Your friend is in huge trouble. Sounds like the attorney did a great job getting house arrest considering the charge is punishable by life in prison. He is facing another 2 life sentences. I would expect some prison time this time.
