Legal Question in Criminal Law in Florida

Using a fake id

I am 20 years old and I just got caught with my fake ID. The ID is my old licence, just the D.O.B was changed. I was giving a citation and have to appear in court next week. What are some of the consequences I could face and what can I do to avoid having this stay on my record because I'm trying to get a government job and go to college? Should I hire a lawyer to come with me to my court date? Any advice would be greatly appreciated.

If this was a first offense, the court may just give you the option of going to a pretrial diversion program or offer you a withhold of adjudication. After that your record can be sealed or expunged.

Email me for more info on sealing after the case is closed. If the court offers you an adjudication of guilt do not take it and get a lawyer.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

If this is your first offense, it is highly likely that the court may offer to place you in a pretrial diversionary program. This effectively takes your case out of the system and if you successfully complete the program, the charges will not go forward. You may increase your chances of getting into a program with an attorney representing you. If the court wishes to proceed on the charges, hire an attorney immediately.

You can then seek to seal or expunge your record after this matter is over if you have never been convicted of any crime in the past. You can either do this on your own or hire an attorney to file this for you.
