Legal Question in Criminal Law in Florida

false accusation by a minor

I was acused of pointing a gun twice at a minor.no weapon was found but the police still tried to have me prosecuted.

I have spent alot of money having this expunged from my record.

Can I sue the parents to recover cost and is there any case law?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You can always sue anyone but there is not guarantee of recovery. It would depend on what evidence you can produce to prove that the claim was false and without merit. As to caselaw, that is your responsibility to research or hire an attorney to do for you. This forum is only to answer short legal questions and not to perform free legal work which would be unreasonable to expect from any lawyer.
