Legal Question in Criminal Law in Florida

With held Judification

I was arrested for a DUI and got with held judification. I was wondering how I would go about seeing if my lawyer sealed my record already. I was also wondering if it wasn't sealed could I still legally answer no to the question ever been convicted of a felony?

Re: With held Judification

DUI are usually a misdemeanor. DUIs in Florida are only Felonies if the following:

1) 3rd or subsequent DUI

2) DUI involving injury to another or death of amother.

Also, in Florida, state law does not allow the judge to with-hold adjudication on DUIs. So if you did receive a withhold, consider yourself very lucky. As far as sealing your record, in Florida you cannot seal a DUI traffic record until after 75 years from the date of the incident.
