Misdemeanor Battery (...)

I slapped a man once for blowing cigarette smoke in my face after I told him to stop. No witnesses. He called police about 8 hours later but no arrests were made. Five months later summons for court is issued but unserved 'cause I no longer lived there so I didn't know and now there is a capias for failure to appear. What should I do? It is a misdemeanor battery charge, but I've never been charged with battery. I have several felonies on my record, been to prison twice, but I am not on probation or anything and I have had absolutely no run-ins with the law for nearly 10 years. Can you help me? What should I do? I want to have this whole incident erased like it never happened - can you say pre-trial intervention or diversion or mediation? Or just plain dismissal? Help! Thank You.

Yo may get pre-trial intervention or probation, but it's not likely given your record. You need a good criminal lawyer right away.
