Legal Question in Criminal Law in Florida

nolle pro & dismissal? which one is better? which can be expunged?

so between nolle pro and dismissal as a disposition, which one of them is a better disposition for a defendant?

which one's record can be expunged? nolle pro or dismissal?

and if so, when will it be able to be expunged? is the arrest record possible to be expunged as well as a nolle pro disposition?

thank you!

Between the two, it really doesn't make any difference. Both are dismissals. The first one is by the prosecutor, the second one is usually by the judge. Either can be sealed and expunged.

You can begin the process of having the entire record, including the arrest, sealed immediately. FDLE is very backed up right now, so it may take several months. You also may be able to have the record expunged, though some judges believe the record has to be sealed for ten years before it can be expunged (shredded).
