Legal Question in Criminal Law in Florida

order of dismissal

I had a conviction that was vacated and dismissed, the judge didn't sign an order of dismissal, the only thing I have is the docket sheet indicating the charges were vacated. that was not enough for immigration purposes. how do I get an order of dimissal signed by the judge, can I do this myself or I have to get a lawyer. thanks

Re: order of dismissal

You can probably do it yourself, but it will be easier if a attorney does it. Contact my office if you need guidance.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You may be able to do this yourself if you know whom to call and how to get the judge's staff to place this on the calendar. Since you are dealing with immigration, you may not have the luxury of time. Therefore, you may wish to retain an attorney who can expedite this matter for you. The cost should be reasonable as the matter should only require one court hearing.
