I need to know if in a case with three child defendants plead guilty, one makes a plea deal to pay the restitution if the state can make the other two pay what ever the one with the deal did not pay. I found this on the internet and not sure if I understand it.An order of restitution entered as part of a plea agreement is as definitive and binding as any other order of restitution, and a statement to such effect must be made part of the plea agreement. If part of a plea agreement includes the payment of restitution, the party must make full payment of the designated amount. If the plea agreement makes no reference to restitution, it likely isnt included.
