Restitution Hearing

The state from what the victim states. Claims the laptop was valued at 200.00 dollars. My argument is they have no serial # no evidence of that this is an accurate value. In fact the lap top was given to victim out of the garbage had no power cord and missing some keys and windows would not load. So the laptop wasn't functioning . Is there an argument as to the actual value of this laptop. The hearing for restitution is in august at best i think 50.00 dollars is fair.There is no way to prove it's worth .Thank you.

I think you are correct. You will have to show some knowledge of the condition of the laptop at the time it was taken. The value is at the time of the theft, not replacement value.
