son's arrest

We got a call awhile ago from a detective wanting to question my son about a burglery in May. He replied with a message. Since he did not know of a burglery he did not go into station. Well this week a detective shows up and arrests him at our home. Charges are defrauding a pawnbroker and dealing with stolen merchandise, both felonies. He took with a ''friend'' to a pawn broker in May to help him out and since the person didn't have his ID, my son signed for the merchandise after this ''friend'' swore it belonged to him. Well it was stolen. What now? My son is out on bail and is willing to talk to detective now that he knows, but what about his charges? and how can he prove this other guy lied. Thanks

First of all, and most critically, your son must HAVE NO FURTHER CONVERSATIONS WITH THE POLICE WITHOUT A LAWYER. He will not be able to talk himself out of this situation. He will only incriminate himself further, and make his case that much harder to defend.

Second, your son will probably have a public defender lawyer appointed for him. If not, he needs to get a lawyer as soon as possible. Of course, if he would rather not be represented by the public defenders' office, he can hire a private attorney. (I know many excellent lawyers who are public defenders.)

If your son is going to provide a statement to the police, he must only do so after he has gotten "use immunity." In other words, anything he says to the police CANNOT be used against him.

first, i would not advise your son to go and speak with this detective without haveing a lawyer present. Your son has two felony charges now and would be speaking directly about the facts of the case. Not a good idea at this time. If this crime occurred in south florida please give me a call.
