Legal Question in Discrimination Law in Florida

What type of proof is need for racial discrimination?

I was hired as a Contract worker. I work for 4 months as technical analyst for four months, The big 10 company I work for called the Contracting company indicating I had one week left to work for the company. Reason given the company did not win a bid on a proposal. However as I was leaving 3 blacks and 1 white were slated to be released. However, the white applicant address the White director asking for a position. The last day the 3 black contractors were released and the white contractor was kept. I filed a complaint to EEOC, the company took 8 months to respond. The companies response was performance, but no performance reivew was given, no written or verbal warnings. I was given awards right up to the last day of work for performance and other emails to dispute any claim they make that the company is not aware of. How do you prove racial or hiring discrimination?

Re: What type of proof is need for racial discrimination?

Employment discrimination can sometimes be difficult to prove. In you case the employer has put forth your performance as the reason you were fired/not hired. In court you will have to prove that reason is false and a pretext for discrimination. Co-workers or a friendly supervisor may provide the testimony you need. Did you recieve any awards, positive emplyee reviews, wage raises .... these items would tend to prove that the company had no problem with your performance. Please be aware that if you have recieved a letter of determination from the EEOC(and regardless of what the EEOC determination was)you must file your Title VII lawsuit within 90 days or you will lose the right to go to court.
