Legal Question in DUI Law in Florida

Reduction of sentence?

I am facing 9 mos. for 3rd DUI in 10 years. My dad has just had a second stroke and needs me to help as caretaker. Lost his job, medical bills, etc.

Any way I can hope to have my sentence reduced due to this?

Re: Reduction of sentence?

Everything helps, though it's tough to get a judge to deviate downward from the guidleines on a felony DUI. Just make sure you get a good DUI defense lawyer. Jail is mandantory, but nine months is not.

Re: Reduction of sentence?

Absolutely. I believe regardless of circumstance, 9 months jail for a 3rd DUI charge is excessive and may be able to be reduced. The information regarding your father's circumstances may prove helpful but dont expect it to carry the day. Hire a DUI defense lawyer in your area and allow that attorney to do his job. If you have additional questions, please feel free to give me a call.
