Legal Question in Elder Law in Florida

My husband and I were recently told by his brother that someone has to live with their mom or the State is going to force her into a home and they will take total control of the property. I have never heard of that in this kind of situation. I do know that they are done paying on the house and the land they just keep up with the basic thing. Please tell me what we can do my husband has always been there for them and we don't have a problem at all we are trying to start a family and this has been really hard on us. Also if there is someone I might be able to talk to in my area it would be great. I just want what is best for every one.

If your in laws are incapacitation, I suggest you get guardianship over them. That will allow you to do some things on their behalf ie. designate a personal care person to come in and clean; or if only one is having severe problems, place that person in a nursing home while the other remains in the home. There are all kinds of scenarios. Contact an elder law attorney.
