My 12 year old has to stay with her father the non cutodial parent half the summer per divorce agreement can she refuse to go if she does not want to go and that she wants to be with her mom instead

Courts do not generally give young children the ability to refuse to spend time with the non-custodial parent. You need to explain to your daughter that it is extremely important that she spend time with both parents.
