Legal Question in Family Law in Florida

Absent ex now wants custody

My divorce was finalized in Florida after 10 months of my ex-wife being pretty much a mother of convenience. She left our son with me when she got a boyfriend in January, and saw him once in a while over the last 10 months, when it was convenient. Due to financial problems, I moved to Texas to work, and let him stay with her so she would have a chance to rebuild the relationship. It has been one week and now she is suing for full custody. I am listed as the reidential parent in the divorce. Can I just bring him to Texas and sue for full custody here? Thanks

Re: Absent ex now wants custody

Not likely. The suit in FL likely prevents filing another suit in TX particularly since the original order was in FL.
