Legal Question in Family Law in Florida

Child Support

My friend's 24-year old daughter has recently been abandoned by her husband of 7 months and he has asked her for a divorce. Her husband resides in FL, but 2 weeks ago she moved to her parent's home in GA with their 3 month old daughter. She wants to seek a divorce and child support. Would it benefit her more financially to wait 6 months and declare GA residency and then file for divorce or, to go ahead and file in FL?

Re: Child Support

should speak with a Georgia attorney regarding their laws since it would be a lot easier for you to file in Georgia.

Re: Child Support

You would have to file the divorce, according to GA law, in the county in which your spouse resides. So, it sounds like you would have to file in Florida regardless.

Re: Child Support

Additionally, you don't have to wait to file anything to get child support. You can contact the Child Support Enforcement in GA for immediate child support, don't wait. ONce that is settled, the rest of the divorce is usually pretty easy.
