how do i get custody of my child after i finish my case plan?

my ex husband gave up my daughter a year and a half ago. i have been working on a case plan to get her back. i have fulfilled all of the requirements of the state. but my parents are saying that even though my ex abandoned her he still has custody and it is up to him when i will be ready. now i have worked hard. i just got out of prison 8 months ago and have prospered very well. what can i do jan 17,2002 when i go to court for the end of my plan, to get her back this jan? please help me i miss her

Keep in mind that the court is required to award custody, visitation, support, etc. as to what is in the best interest of the child. You must show the court that it is in the best interest of the child for you to have custody, that you can and will care for her as a loving parent, that you will provide visitation to the other parent, that you can support her, etc. Contact the agency caseworker or whomever now is acting as guardian to inform her or him what you want and that you are arranging your life and plans accordingly. Go for it. It is not clear whether your ex will contest the matter, has abandoned the child, etc. You are also advised, especially if custody will be contested, to consult with a local family law attorney for representation of your interests.
