Legal Question in Family Law in Florida

Custody

My sons father and I were never married, my son lives with me, legally, who has full custody, and if it's not me then how do I go about getting it?

Also, if something happens to me, how do I make sure my son doesn't go to his father? Do I need an attorney to make out a will for that or what?

Re: Custody

You should file a Paternity Action to establish who the father is. Once that has been established then the issues of custody and support get addressed and resolved. In the meantime you should have a Will drafted naming a preference of a guardian for your son. Feel free to contact me if you have any further questions. Sincerely, Melody Stickel-Martinez, Esq.
