Legal Question in Family Law in Florida

my daughter is in drug rehab her x husband served her with papers but because she is in rehab they can not serve her there they served me her father and put on summons daughter c/o father now i can not call her or act on her behalf and she has 20 days to answer or lose is this legal and ethical for a lawyer to do knowing they know she is rehab as it states in summons
