Legal Question in Family Law in Florida

Establishing Paternity for an Adult

I am married to a man that has one child from a previous relationship. This child is 29 years old. My husband has a good relationship with his son now, but for years it was rocky due to the behavior of the child's mother.

Recently my husband took his son's side in a squabble with his mother. The mother blurted out: ''He isn't your kid anyway. Now don't you feel stupid for paying child support.'' She said other things which are unprintable.

My husband is hurt and furious. He paid child support for years and helped with college based on the fact this woman said the kid was his. They never got a paternity test (they were in their teens when he was born).

He told one of his son's relatives what was said. He was told that everyone in the Mother's family knew she had lied about paternity, because she bragged about getting child support. His son never knew either.

This lady has made many lives miserable and it is not the first time she had commited fraud for financial gain. Is it possible to sue the mother for fraud or a return of the child support if my husband is not the father? Her son says that he wants to sue her also if possible.
