Legal Question in Family Law in Florida

need a FLorida lawyer

My husband has been paying child support since the early 1980's for 2 children, he had with his exwife.

We live in NJ, his pay has always been garnished, payments are sent to Baltimore MD (state where he lived after his divorce, ex lives in Florida). In 1991 he received a letter of arrears for a total of 34,000.00. We recently went through all the paystubs he has on hand and our total to date is over 36,000.00 payed since 1991. His children are 31, and 30 yrs old, and his pay is still garnished.

We asked to have his case moved to NJ where he lives and been told no on numerous occasions by child support in MD.

We need a lawyer to help us fight this, because he does not owe any more money, like I said we have alot of paystubs, some missing but we have alot on hand. Will he get all the money back that he has overpayed? Is it retroactive in FL? Will anything happen to his ex for cashing these checks, that she knows she is not entiltled to.

We really need help, and we need a great lawyer who is willing to help us with this case. We like to get this straightened out once and for all.

It's probably best to file in whatever state is collecting the support. It sounds like that's Maryland, so you probably need a lawyer there. If the original divorce was in Florida, you could also file in the original divorce case.

Determine which state you need to be in, then contact an appropriate lawyer.
