Guardianship of our grandchild

My daughter is a crack addict in rehab for the third time in two years. My husband and I are caring for our granddaughter and we have a ''Temporary Guardianship'' form signed and notorized. There is no father in the picture. I know that only a judge can grant permanent guardianship. Does my daughter have to agree? Can we do it while she is in rehab? Is that our best option? What does it entail?

While her consent may not be necessary, she must be notified of your appplication.
