Can I leave the state with my children?

I filed for divorce about two months ago. Since then, my husband has moved out and has only seen the children upon my insistance (each time he was alone with them, he got drunk).

I have an opportunity to move to another state with the children. He, however, says he doesn't want me take the children away from him (despite his lack of initiative to spend time with or even see them). Where I want to go has one of the best school systems in the country...and has been rated consistantly as one of the best places in the country to raise children. I'll also be entering into a relationship with a man who never touches alcohol, shows fatherly interest in the children and has a healthy, stable family life.

Can I leave the state with them during the divorce?

You would need either your husband's approval or by court order to leave with your children to another state. Be sure to include your request to move in your divorce case.
