Is it legal for mother to take children and live elsewhere but in the same area?

It is difficult to answer this question without more information. If there are no court orders in place and no pending family law cases then a mother can move anywhere she wants with her children. If there is already an open case or an order in place then the answer will depend on what the orders require. Typically, a parent can not move the children more than 50 miles without court permission or the permission of the other parent.

Depends on local court rules but as a general proposition a parent can move up to fifty miles without court permission; if over fifty you need to notify the Judge. Remember you must file the change of address with the Clerk of Courts.
