Marital Assets

Me & Wife divourcing she was served before the house was sold. She says that since she has made improvements to the home. I will owe her money from the house and therefore I will not get any money back from the selling of the home because it will go right back to her is this correct? My attorney says no her attorney says that she will get this money who is right?

Generally, if you are negotiating a matrimonial settlement, you need to have a game plan - both strategy and tactics. You also need to be able to compromise, if you ever hope to reach a settlement in your lifetime and avoid a trial.

Some home improvements may increase the value of a home; some may not. What does the BROKER think? Was there an appraisal?

If you do not have confidence in your attorney's advice on this issue, then I suggest that you get a Second Opinion from an experienced matrimonial attorney in your state - not just on this issue, but on the handling of the whole case.

If the Second Opinion supports your present attorney, then you will be buying peace of mind.
