Can I move to another state with my child if my wife and I are seperated but no divorce filed and my child has been living with her?

Technically, the answer is yes. However, all you will likely accomplish is to force her to start court proceedings. The judge may not look favorably upon your attempt at self-help. There is a very good chance the Court would Order you to return the child.

If the marriage is over, then it is over.

If you opt to proceed without the assistance of counsel, be aware that you will not be entitled to a �do over� if things go badly.
