Possible paternal parent trying to get custody of 3yr old, I am currently married and have been for 11 years but separated for 4 yrs. Paternal parent trying to get custody due to injunction I placed against him for violence to me and my children. Possible father has a felony battery, punching pregnant girlfriend and breaking her jaw appx 10 yrs ago. does my husband have legal custody with me and will felony battery diminish possible fathers rights? in Florida

If he is not on the Birth Certificate you need to file a Paternity Action in your court. Ask the Judge for DNA test, mandatory upon request of either party. Is conclusive as to rights.

The aunt has zero chance of getting custody. That said you should file for full custody against your husband. Use of a lawyer is recommended in your case.
