Legal Question in Family Law in Florida

I am separated from my husband and my divorce is not final. I am having a child with my boyfriend. He wants the child to have his last name. What is the law on this?

YOu can name your child anything you want. However, your current husband is the legal parent of the child. He will have to file a petition to disestablish paternity in order to clear him in the future of paying child support. Plus your boyfriend will have no rights to this child as long as you are married. If your ex husband to be is ready to sign papers, I suggest you get this done before this child is born.
