Legal Question in Family Law in Florida

My sister is dating a man that has a record for sexual offender. He was 19 at the time when it happened. He was dating a girl who lied about her age. She was between 12 and 15 years old. Her parents found out and had him arrested even after she admitted she lied about her age. Now her ex husband found out about this record and threatened to take full custody of the kids if she continued to see him. They do not live together and he is allowed to be around children with another adult present. Because of the situation he has stopped letting him come to her house or be around the kids. Could she in fact lose custody even if they do not live together? And does she have to keep him away from the kids at all times like she is currently doing?
