Legal Question in Family Law in Florida

I have a son with someone who is chose not to be a part of our lives nor does he want to be a part of my son's life. My son has my last name, not his father. Should I marry someone one day and I want my husband to adopt my son, do I need to file a petition to have his biological father's parental rights terminated in order for my husband to adopt my son? I do not have child support and do not want it.
