Legal Question in Family Law in Florida

Okay so my sons father was arrested and deported. We were married Feb. 15, 2012. and have a 3 yr old son together. The father has not spoken to or even tried to get in contact with our son in bout 2 yrs. I want to get my sons last name changed to mine and have full custody. I have recently started the divorce. I want to know can I get my sons last name changed and full custody without the fathers approval?

You ave to get service of process upon him plus a court order for both things. Use of a lawyer is recommended.
