Legal Question in Family Law in Florida

My wife is going to a "church" La Luz Del Mundo it seems very odd and after research i am concerned for our children ages 6 & 3. I have read terrible things about this "church". I am at the end of my rope with it and i want ensure my childrens safety. our marriage is most likely over but i need to know how to proceed. Also she is a permenant resident from Honduras and in my opinion if she knows I am looking at this she is a flight risk or could use this church to hide them from me.

You need to come up with specific reasons to justify your concerns.

If there is enough to go on, a judge has discretion to grant an injunction to stop her from removing the children from the State, and/or to stop passport services for the children. A judge also has discretion to grant you temporary sole custody. If appropriate, all of the preceding can be done on an emergency basis.

I have done the research on this organization and feel you have reason to be concerned. However, without any evidence of wrong doing you will not succeed in your challenge. You will need to seize their passports to ensure that they can not leave the country. If they have not yet obtained passports and you do not consent to them, she would have to get a court order to obtain them. You could move away from the area that you are currently living to ensure less contact with the church and perhaps involve them in the Catholic teachings. Either way, you will need to decide what you plan to do - either file for a divorce and ask for custody with her having visitation rights - which is extremely hard unless you can prove she is unfit. The gist of visitation would give you probably every other weekend and one day during the week at which time you can expose the children to a different religion when you have them with you. You can have a guardian ad litem appointed to see how this is affecting them - but they are so young - may not be of much help in court, and you can have a psychological evaluation and home study done to see the effects on the children in the home.

One thing is very clear - you will need an attonrey to help you through this.
