buying item from party @$18,500.00usd, paid $5500 usd, party retained item, not able to use item now due to unforseen issues, asked for $5500usd back , have had no respones from party after many calls and e-mails, sent certified letter, ( demand letter ). no reply. what legal action canItake to recover this money/ or can I/

You should have had a written contract. In light of the monetary amount, the contract should have been drafted/reviewed by a lawyer. You will now have to sue the seller to get a refund. You may or may not be entitled to a refund, depending on the terms of your contract.
