Can you a sue and out of state defendant in small claims court?

It depends. You can file suit in the county where the dispute or event which gave rise to the lawsuit occurred, where payment under a promissory note is due, etc. I recommend that you contact the Clerk of Court for you County for more information about Small Claims Court.

Yes -- no problem. It is sometimes hard to get service depending upon where there person is located and if yu know where they are.
