Legal Question in Insurance Law in Florida

our truck was stolen. We waited past the 20 days for it to be found and the insurance co. made a offer to us but we declined it because we wanted them to consider the $2900 we just put into our truck on tires and springs to carry the weight of our camper. They said they would process it again but before they got back to us with a new offer our truck was found. The people were caught in the process of taking our motor out so parts were removed. Question: Can we refuse to take the truck back? We are not sure what shape our truck is in but the officer that recovered the vehicle said he would total it.

It depends on the condition of the truck when recovered. Your contract with the insurance company likely provides that they will total it if it is more than 50% of the truck value to repair it. I would suggest you let the insurance company evaluate it and see.
