Legal Question in Intellectual Property in Florida

Conflict in trademark registration

How do I know if a trademark has potential conflict with others? I want to file a trademark but there are others that are similar. What is the criteria the trademark office uses to make a decision on whether two trademarks conflict or not?

You can hire a trademark lawyer to conduct a search for you on potentially confusing marks and provide you with an opinion letter. The opinion letter would provide protection were you to be sued for bad faith registration (knowing of the others' registration or use).
