Legal Question in Landlord & Tenant Law in Florida

Eviction

My husband and i moved my son girlfriend into our home to help her out. We told her that until she gets a job she had to help keep up the house. She did not help with anything around the house. She now has a job and we told her that now had to start paying rent. She still has not payed any rent. We want to know how we can legally evict her?

Hello: I just read your question. From the facts you have written, it doesn't appear you have a legal landlord/tenant relationship with the girl. Thus the rights and obligations for each party under Florida Statutes for landlord/tenant law would NOT apply. As such, you do not need to evict her with a law suit. You can do that, but you would have to know the procedures, have the forms to file, pay the filing fee and cost to have her served (upon winning, the court would order her to reimburse you, but you may never get that money!). Or, you could hire an atty. to handle the eviction case.

Your other option is to change the locks and put her belongings outside. You may even want to call a police officer over to make sure things stay cool and perhaps, to scare her and show her you are serious. Good luck.
