Legal Question in Landlord & Tenant Law in Florida

gave my landlord a check post dated for a week later. he said fine not a problem. 3 hrs later his wife called 5 times cursing and yelling. 1hr later she was at my door handed me the check . she said she didn't want it. I said fine I will be out by the first. she said fine, that was 4 days ago. today he called and asked for the rent check, I said to him your wife gave it back, and we agreed that I would be out by the 1rst. now he is threatening me with a 3 day notice of eviction. what can I do

You can learn not to rely on what people say alone but get all agreements in writing. They can evict you for non payment. If you don't pay then a 5 day summons can be issued and you will have to pay to the court registry. If no payment the judgment will than issue. That could all occur prior to 8/1/13. Get an agreement from them in writing about allowing you to stay. Be careful as of 7//1/13 they can accept less than full rental and still evict you. You need to get an agreement that says they will allow you to stay with whatever you pay and they wont evict.
