If a landlord has evicted a tenant ( adult 24 yeard old) due to nonpayment of rent,Can the landlord file a judgement against the tenant and the tenants mother? The landlord claims he has a verbal contract with the tenants mother that she will pay the rent if the tenant doesn't ..

Hello:

I just read your question. Since I do not know all the facts, this is not a formal legal opinion and this is not an atty/client relationship. This is a general discussion of legal principles.

As such, If you want a judgment for damages against the tenant, you have to file a law suit. If you filed an action for eviction, you could have added a count two for money owed. You may be able to amend your pleadings in that case to add that count two for damages.

As for the tenant's mother, unless she was on the lease, you will probably not be able to get a judgment against her. You might want to get assistance from an atty. If we can be of assistance in North Fla., please call my office. Tom Rosenblum
