Legal Question in Landlord & Tenant Law in Florida

Landlord/Tenant Question

Good Morning,

I have a friend that has a roommate who she is deathly afraid of. On Memorial Day, he was drunk and kept trying to get to his gun that was under the mattress and she would not let him get to it. He fell in his drunkenness and she called 9-1-1 and he was transported to the hospital. She cannot get him out of the house. Today, she filed for a restraining order, and the judge denied it. He said that ''no violence was alleged.'' He's drunk, and going for his gun! We cant believe it! She is staying at my house and is going to continue to do so because she fears for her life. We need help getting this person out of her house. He continually drinks to inebriation every night, and she is terrified of being around him. We cannot believe the judge denied it. Now I understand why so many women are battered and abused and don't leave. The judge won't make the man leave and they have nowhere to go!

My name is Edward Dean, and I am writing this for her as she is extremely upset.

Thank You

Ed

Re: Landlord/Tenant Question

If he is a tennant, you will need to evict him. If he is not a tennant, but just a boyfriend sleeping over (I hopoe she leans her lesson about that, by the way), then tell him to leave. If he refuses, wait till he is gone and then change the locks and have his stuu ready for him when he comes back. Secure the gun if you are worried about it. It will probably help if some male friends stay over for a bit and help.
