Legal Question in Landlord & Tenant Law in Florida

rental

My son has an apartment in Tallahassee. one roommate has moved out and is not paying the rent in spite of a signed lease with the property managers. Is this a small claims situation? Do we file it in Orange park--where the parents of this student live--or in Talahassee where the apartment is?

An action for this most likely should be brought in Leon County where the contract was entered into. It is unclear from your post if this person's lease with the property manager makes your son responsible for the rent in the event that the roommate moved out.

As for whether it is small claims depends on the type of suit and the amount that should be brought.
