Legal Question in Landlord & Tenant Law in Florida

I need help

We are renting an apartment and also a washer and dryer from them as well. Several months ago my washer stopped working and I called them to put in a work order to fix it. It took them a week to get things corrected, What ended up happening is they hadnt had it fixed in a week and 2 days so i told them to just bring me a diffent one which they did. Now my dryer is not working. I put in a work order to have it looked at on tue. it is friday and I called and there wont be anyone here until monday to look at it, and if it needs a part who knows when it will be fixed. My question is can I make them deduct 2 weeks rental on this washer and dryer since there was 2 weeks that i couldnt use one or the other. They are telling me that I can not.

Hello: I just read your question. In general, I do not believe you can withhold rent for this deficiency. Fla. Statutes deems substantial deficiencies such as, no water or broken a.c. or heating as a "constructive eviction" and would allow tenant some remedies against LL. Even in those circumstances, the law may require tenant to place rental $ in the clerk of Court's registry until the matter is resolved. I have not researched that in a while. This deficiency would prob. not be deemed substantial. You can read Fla. Statutes online...chapter 83. 'Sorry about that. Good luck. Tom Rosenblum
