I am renting a room in my house and have a signed 30 day notice to vacate, month to month lease with my tenant. A section of my lease says no one can use the premises for illegal purposes. I found out my tenant smoke pot, I saw a small jar of it and her pipe on the deck. I asked her to stop smoking and bringing pot around my house, she said she would not stop. Can I evict her immediately? Do I have to call the police on her? Do I have to give her a 30 day notice?

Eviction is a civil process and you need to follow the statute. IF you have a month to month lease, all you have to do is give 15 days notice that the lease will terminate. You don't have to provide a reason. If she does not vacate you can file the eviction based on the notice. I would not mention the reason at any time.
