Legal Question in Medical Malpractice in Florida

My cousin was the driver in an accident where he was injured. He had lost consciousness and hit a house. After being in the ER and receiving care, he was told not to drive for two weeks. Six weeks after the first accident, he was the driver in a second accident where he, again lost consciousness and this time was severely injured and in the hospital for three months. He has had to endure several surgeries and is still going to wound care weekly. My question is: isn't there a mandatory six months to lose a license when there is loss of consciousness and if so, shouldn't the hospital bear responsibility for the second accident for not suspending his license?
